NEW REGULATIONS ON MANAGING, PROVIDING AND USING INTERNET SERVICES AND ONLINE INFORMATION


On November 9, 2024, the Government issued Decree 147/2024/ND-CP on the management, provision, and use of Internet services and online information.

Below are some of the new regulations related to the management, provision, and use of Internet services and online information:


I. User account verification via phone number

According to Point e, Clause 3, Article 23 of Decree 147/2024/ND-CP, social network service users' accounts must be verified using a mobile phone number registered in Vietnam. Only in cases where users confirm they do not have a Vietnamese mobile phone number, foreign organizations, businesses, or individuals providing social networking services can verify accounts using a personal identification number in accordance with the legal regulations on digital identification and authentication.

As stipulated in Point b, Clause 3, Article 27 of Decree 147/2024/ND-CP, if users utilize livestream features for commercial purposes, service providers must verify accounts using personal identification numbers in line with the laws on digital identification and authentication.

Only verified accounts are allowed to post information (write posts, comment, livestream) and share content on social media.

Clause 10, Article 82 of Decree 147/2024/ND-CP requires that within 90 days from the effective date of this decree, foreign organizations, businesses, or individuals providing cross-border information services into Vietnam, and local social network service providers, must authenticate active user accounts according to the regulations in Point e, Clause 3, Article 23, and Point b, Clause 3, Article 27 of Decree 147/2024/ND-CP.


II. Removal of content violating the law upon request

Point b, c, Clause 3, Article 23 of Decree 147/2024/ND-CP requires the inspection, monitoring, and removal of information, services, or applications that violate the law as specified in Article 8 of the Cybersecurity Law 2018.

Upon the request of the Ministry of Information and Communications, the Ministry of Public Security, or other competent authorities, service providers must block or remove information, services, or applications that violate legal regulations, following the process outlined in Clause 5, Article 23 of Decree 147/2024/ND-CP.


III. Temporary or permanent account, group, or channel suspension for violations

Clause 7, Article 35 of Decree 147/2024/ND-CP specifies:

- Temporary suspension of social network accounts, community pages, community groups, or content channels in the following cases:

+ Posting at least five times with illegal content within 30 days.

+ Posting at least ten times with illegal content within 90 days.

- Permanent suspension of social network accounts, community pages, community groups, or content channels in the following cases:

+ Posting content that threatens national security.

+ Having been temporarily suspended three or more times.
